1. The ultimate cause was the failure of Esso to
equip its employees with appropriate knowledge to
deal with the events that occurred.
- Not only did Esso fail to impart its knowledge
to its employees, but it failed to make the necessary
information in the form of appropriate operating
procedures.
- Lack of knowledge of operators and supervisors
was directly attributable to a deficiency in their
initial or subsequent training.
2. Esso breached the Occupational Health and Safety
Act by failing to maintain a working environment safe
and without risks to health.
3. The reduction of supervision at Longford, including
the transfer of engineers to Melbourne, necessarily
meant a reduction in the amount and quality of the
supervision of operations.
